END USER LICENSE AGREEMENT (EULA)

This legal document constitutes a binding contractual agreement between you (the "User" or "you") and Eos Mist Ltd ("the Company", "we", "us", or "our"), a corporation organized and existing under the laws of Israel, with its principal office located at Hakeren st. 1, Ranana Israel.

This end user license agreement ("EULA" and/or "Agreement") provisions regulate your right to enter and use the setup tool and all corresponding associated software components related to the application known as Squeezee ( "Installer" and/or "Software"). By proceeding to download, install, use, or operate the Installer, you (the "User" or "you") formally acknowledge that you have reviewed, understood, and consented to be legally bound by these Agreement.

Ownership and Scope

The Software is the exclusive property of the Company, and either owned by and licensed to it. This EULA applies to every elements of the Software, including its specific modules, features, internal tools, and any supplementary services provided, such as integrated search functionalities.

Acceptance of Conditions

By accessing, installing, utilizing, or making any use of the Software, you confirm your acceptance to these Agreement and the accompanying Privacy Policy ("Privacy Policy"), and agree to comply with all applicable laws and regulations. If any part of this Agreement is not acceptable to you, you must immediately halt the use of the Software and remove it from your systems. To facilitate performance monitoring, security, and data analytics, the Software may process specific technical and usage-related data essential for its operation. We strongly recommend reviewing the Privacy Policy prior to setup.

Software Provisions

By starting the setup process, you grant the Company permission to install the Software and any background files necessary for its execution. During the installation, and subject to your consent, the Software may modify certain browser settings- such as your default search engine, home page, or new tab layout-to integrate a search provider selected by the Company. Proceeding with the setup serves as your explicit authorization for these changes. Should you remove Squeezee at a later date, these browser configurations will not automatically revert; manual restoration via your browser settings will be required. You also acknowledge that Squeezee may function as your default file processing utility and may include search tools powered by third-party providers.

License Grant and Restrictions

The Company awards you a limited, non-assignable, revocable, and non-exclusive license to use the Software solely for personal, non-commercial purposes. All rights not specifically granted in this document are strictly reserved by the Company or its licensors.

Third-Party Content

The Software may incorporate or provide access to third-party materials, promotional content, or external platforms. The Company does not control, endorse, or assume liability for any third-party products or services. Any interaction with such third-party content is undertaken at your own risk and may be subject to the relevant third party’s own terms and policies.

User Obligations

You agree that you shall not:

  • Reproduce, distribute, sell, lease, or commercially exploit the Software.
  • Modify, decompile, or attempt to reverse engineer any part of the Software’s code.
  • Circumvent security protocols or seek unauthorized access to the Software’s infrastructure.
  • Utilize the Software for any fraudulent, illegal, or malicious activities.
  • Violate any of the provisions set forth in this agreement.

Any breach of these obligations may lead to the immediate termination of your license and potential legal action.

Intellectual Property

All rights, titles, and interests in the Software—including source code, trademarks, designs, and proprietary assets—remain the property of the Company or its partners. Nothing in this Agreement does not transfer any intellectual property ownership to the User.

Warranty Disclaimer

The Software is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. The Company does not guarantee that the Software will be error-free or function without interruption. You assume all risks associated with the use of the Software.

Liability Limitation

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Software. The Company’s total liability is capped at either $10 USD or the actual amount paid by you for the Software, whichever is less.

Updates and Modifications

At its own discretion, the Company may release patches, improvements, or fixes for the Software. Your continued use of the Software after such updates indicates your consent to them. Temporary downtime or functional changes might occur during these updates.

Termination

This Agreement remains in effect until terminated. You may terminate it at any time by uninstalling the Software and ceasing all use. The Company may suspend or terminate your access immediately if you violate these Agreement or if your continued use poses a risk to the Company, its users, or third parties. Upon termination, any rights granted to you cease, and any continued you use of the Software constitutes a breach of these Agreement.

Changes to Terms

The Company may revise these Terms from time to time. Updated versions take effect upon publication. Continued use of the Software indicates acceptance of the revised Terms.

General Provisions

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

Failure to enforce any provision shall not constitute a waiver.

You may not assign these Terms without the Company’s prior written consent.

Governing Law and Jurisdiction

This EULA is governed by the laws of the state of Israel. Any disputes shall be settled exclusively in the competent courts of Tel Aviv. Claims must be filed within one year of the incident.

Force Majeure

The Company shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, power outages, or governmental actions.
